ADMINISTRATIVE HISTORY OF NARNAUL

Narnaul is the District Head Quarter of District Mahendergarh (Haryana). It is an ancient city of this South Haryana Region having historical importance. Narnaul city was firstly founded under the lap of Dhoshi hills and enjoyed a very high reputation for spirituality.

It is said that name of the city Narnaul has developed from the original name NAHAR NAUL means Forest of Tigers. In the ancient times it was dense Forest Area. Narnaul has ever been famous for Mehandi product. Report of a tour in Punjab and Rajputana by Mr. H.B. Garrick Vol. 23 in year 1883 has used a couplet that BRING A MEHENDI FROM NARNAUL and PAIR OF SHOES from Gujrat.

Town Narnaul is situated on Ajmer-Rewari Railway Track and at a distance of 135 km from National Capital Delhi. In the Vedic period Dhoshi hills is called as Archik Parvat which is at a distance of 7 k.m. in West side of present town Narnaul.

In post Vedic period it was called as Nandi Gram in Dwapar Era. In this regard a stone tablet is also found in Narnaul which was installed in Lord Surya Narain Temple by Sawai Raja Jai Singh Jaipur in 18th Century.

In pre-Muslim period, Copper Coins were minted in this area during Chandragupta Maurya when it was under their control in or around the year 324 B.C. Thereafter this region came under the control of Yodha period but from 335 AD to 5th Century it remained under the control of Gupt Empire.

This area remained further under the control of Pratihar Kings during 795 to 833 AD while Tomer Rajputs were having control of North Haryana Region. Thereafter it remained under the control under the Kings who ruled Delhi like Anangpal Tomer II from 1043 to1081 AD and thereafter it passed on to Arun Raj Chauhan King of Ajmer in 1139 AD and remained under their control till 1191 AD when Prithavi Raj Chauhan lost the Battle and Mohammed Gauri took over the control in 1192 AD.

Present town Narnaul was founded by Raja Nunkaran of Sambhar ruled over the area of Kanaud (old name of Mahendergarh District) who had established Chamunda Devi temple in Narnaul. However he lost to Shah Wilayat Khan in 11th Century. Shah Wilayat Khan was also known as Hazrat Turkman, a Muslim Religious Preacher and warrior. He was killed by son of Raja Nunkaran after sometime year 1136 AD.

Rajput rulers had built a city wall around present city Narnaul having 3 gates i.e. Kanaud Gate at Pull Bazar, Delhi Gate at Bajaja Bazar and third gate near Mohalla Paniganj.

During this period Budh and Jain religions also developed in this area.

In Pre-Muslim and Muslim period Narnaul was a famous business place falling on trade carvan route between Middle East and Iran to Delhi via Sindh, Bahawalpur, Jodhpur, Ajmer, Narnaul. Town Narnaul had a strategic position. During Sultnate period, Narnaul area was under the control of Pathans and first Pathan Garrison was established at nearby village Thana. Muslim Invaders caused a lot of destruction to temple, Ashram and religious places. By passage of time Narnaul became a prominent centre of Sufi Saints.

In or around the year 2006 AD area of Narnaul came under Turkish Rulers. During that time a small Fort was built by Rai Jahar Dev of Malva at Manderi hills in heart of City Narnaul who had got control on this area. Some historians have written that this Fort was built by Rajput Rulers and later on repaired by Rai Jahar Dev. However again this area came under the control of Muslim Rulers when Balban invaded this area in 1251 AD and his arrangement continued up to 1290 AD and thereafter it came under the control of Khilzis, Tughlaqs, Saiyeds and untimately under the control of Bahlol Lodhi in 1450 and Lodhis rules up to 1526. During this period a Jagir near Narnaul, having head quarter at nearby village Simla (now in Rajasthan) was given to Ibrahim Khan Sur (grandfather of Shershah Suri, called as maker of G.T. Road).

Thereafter Narnaul also became part of Mughal Empire by Babar who had divided his kingdom in 4 Sarkar i.e. Sirhind, Delhi, Mewat and Hisar Firoza. Narnaul was put as part of Sarkar of Hisar Firoza. For sometime this area remained under the control of Hemchander (known as Hemu) of Rewari of Bhargav Community. But he lost the Battle to Akbar on 5 November 1556 at Panipat.

During regime of Akbar, Mughal Empire was divided in to provinces which were further divided in to Sarkar and these were further divided in to Mahal. Village was the smallest Administrative Unit. As per Aine-Akbari, Narnaul was a Sarkar/like District under Province of Agra, having 4 Mahal/like Tehsil known as Narnaul, Kanti, Khudana and Kanaud (now Mahendergarh). A mint was established at Narnaul for production of Copper coins. Various monuments were built up.

This administrative set up continued up to fall of Mughal Empire. In 17th Century Abdul Latif Abbassi historian visited Narnaul in the year 1608 and his travel memories, he has described Narnaul town as an early image of paradise. During regime of Akbar Narnaul was established as District Head Quarter having the seat of Deputy Governor.

Later on during start of 18th Century, Muslim Ruler Mohammad Shah had granted the title of Rao Bahadur to Gujarmal, elder brother of Rao Balkrishan and granted him Jagir of 52 villages of District Hisar and 52 villages of Narnaul which was including the area of Kanaud as well. His successors could not retain the control on this area and it was invaded by Baluch Nawab of Farrukh Nagar, Jhajjar and Raja of Jaipur. The Chaos had developed during that period and the unrest was spread up to year 1803. During this period this area remained under the control of Raja of Jaipur in 1750 AD and thereafter under control of Marathas up to 1803 AD. Under the treaty of Sarji-Arjun-Gaon, Scindhiyas handed over this area to British India Company who made it a part of State of Jhajjar in the year 1803 which was created by the britishers after Anglo Marath War. This grant consisted of the Parganas of Jhajjar, Kanaud, Narnaul, Kanti, Bawal, Badhwana, Dadri, Bahadurgarh and patodi. State of Jhajjar was having the control of this area up to 1857 AD when it was confestated and divided in to many parts after failure of first freedom movement in year 1857.

Thereafter area of Kanaud (known as Mahendergarh now) and Narnaul were given to State of Patiala while area of Kanti, Bawal, Atli, Kanina were given to State of Nabha and area of Dadari was given to State of Jind.

Thus this area remained under these three States up to the freedom of country i.e. 1947. Afterwards it was made a part of State of Pepsu during year 1948-56, part of Joint Punjab during 1956-66 and as part of State of Haryana since 1.11.1966 to onward.

HISTORY OF JUDICIAL SYSTEM IN NARNAUL

A regular system of Administration of justice was functioning in State of Patiala where the Judiciary and Executive were common and joint. Thus the courts are functioning at Narnaul since 1858 under the regular judicial system. At that time District Head of Executive and Judiciary was called as Nazim having Head Quarter at Narnaul. From 1858 to 1905 16 Nazims remained posted at Narnaul.

In those days there used to be Mukhtiars to plead the cases on behalf of the litigants. After gaining some experience of certain period, they were required to appear in the exam of pleader held by Ministry of Law and Justice Govt. of Patiala.

High Court was established at Patiala on 1.11.1919 by Farman-I-Shahi No. 54.

In the year 1936 the powers of District and Sessions Judge was taken away from the Nazims under Notification No. 20 dated 16.9.1936 issued by H.H. Govt. Gazette of Patiala under the authority of Hon’ble Chief Justice and Ministers H.H. Govt. of Patiala thereby taking steps to separate judiciary from the executive. Nazims were left to exercise the power of only District Magistrate. Under this Notification 3 post of District and Sessions Judges were created at Patiala, Sunam and Bhatinda. Narnaul was under the control of Session Division No. 3 at Bhatinda.

Sardar Fazal-I-Haq Khan was the first independent District and Sessions Judge of Session Division No. 3 at Bhatinda appointed on 16.9.1936. He used to hold circuit court at Narnaul for trial of sessions cases. He was also designated as court of original jurisdiction to try the civil suits of the value of above Rs.5000/-. Naib Nazims were also appointed who used to commit the cases for Session Trial.

Vide Notification No. 11 dated 20.7.1937 two Honourary Magistrates namely Sh. Ahmad Ali Khan Retired Risaldar and Sh. Sheochand Rai Zaildar were appointed as Magistrate 2nd Class of PS Satnali and Mahendergarh and land suits of the value of Rs.160/- or below and money suits of the value up to Rs.200/- with power of Sub Registrar.

To improve the administration of law and justice system and to maintain the faith of State Subjects in Competent and impartial judiciary, State of Patiala issued Farman-I-Shahi bearing Notification No. 52 Vol. 33 dated 21.2.1943 for separation of Judicial and Executive Services.

The court of record for Patiala State was called as Judicial Committee of Ijalas-I-Khas with jurisdiction to hear appeal from the decree or final order on original jurisdiction or appeal by a bench of two or more judgments of High Court of Patiala in Civil side; against the order of Single Bench, passed in cases of difference of opinion between two judgment of High Court; when case is certified by High Court as fit for appeal to the judicial committee; under SLP granted by judicial committee.

It was also empowered to hear the reference to H.H. Maharaja of Patiala through judicial committee when the punishment given was for death/life for confirmation.

Earlier established High Court of Patiala was also empowered to make rules for qualifications and admission of proper persons as Advocates entitled to appear, act and plead before it and also of pleaders entitled to appear, act and plead in Subordinate Courts.

Later on this District was put under the Administrative control of Sessions Judge Sangrur during the time of Pepsu and Punjab. After carving out new State of Haryana, this area had been put under the control of Sessions Division Gurugram for a long time and thereafter under the control of Sessions Division Bhiwani and then independent Sessions Division was formed at Narnaul in 1983.

Meanwhile for some couples of year the enhanced appellate powers were also conferred on Senior Sub Judge Narnaul to hear the appeals but afterwards the court of Hon’ble ADJ was established.

From year 1858 to 1982 the courts were hosted in complex of Sarai Rai Balmukand. However in 1983 it had been shifted to New Judicial Complex. New buildings were also inaugurated in year 2009 for appellate courts.

ACHIVEMENT OF MEMBERS OF BAR ASSOCIATION NARNAUL

Mr. Justice S.K. Mittal was member of this Bar Association initially and later on shifted to High Court for practice and he became Judge of Punjab and Haryana High Court during July 2002 to 4.3.2016 and then he became as Chief Justice of High Court of Rajasthan and remained as such from 4.3.2016 to 14.4.2016. Thereafter he remained as Lokpal of Punjab during 10.11.2016 to 21.4.2018 and also remained as Chairman of Haryana Human Right Commission during 23.4.2018 to 22.5.2023.

Mr. Justice Naresh Kumar Sanghi was member of this Bar Association initially and later on shifted to High Court in 1996 and was appointed as Deputy AG Haryana and then Additional AG Punjab. Later on he was elevated as Judge of Punjab and Haryana High Court but unfortunately died during service.

Mr. Justice N.S. Sekhawat, presently Judge Punjab and Haryana High Court, also practiced for a brief period in this Bar Association.

Mr. Dinesh Kumar Mittal, previously member of this Bar Association remained as Judicial Officer in Punjab and then in Haryana and now posted as District and Sessions Judge Hissar.

Mr. R.P. Yadav, previously member of this Bar Association, later on shifted to High Court for practice but appointed as Judicial member in ITAT and now he is posted as Vice President in Income Tax Appellate Tribunal Chandigarh.

Mr. R.K. Yadav, previously member of this Bar, remained as judicial officer in Haryana and retired as District and Sessions Judge Rohtak.

Smt. Bimlesh Tanwar previously member of this Bar Association, remained as Judicial Officer in Haryana and retired as District and Sessions Judge.

Mr. R.S.C. Mittal (now deceased) was member of this Bar Association and elected many times as MLA Narnaul and remained as Speaker in Pepsu, Minister in Punjab and Haryana.

Mr. Rao Nihal Singh (now deceased) was member of this Bar Association and elected as 5 times MLA from Nangal Chaudhary, Ateli, Mahendergarh and also remained as Minister in Punjab and Haryana and also President of Haryana Congress Committee.

Mr. M.L. Saini (now deceased) was member of this Bar Association and elected as two time MP from Mahendergarh and Kurukshetra.

Mr. Rao Narender Singh member of this Bar Association and elected as MLA from Ateli and Narnaul and also served as Minister in Haryana.

Mr. Kailash Chand Sharma (Amarpura) member of this Bar Association was elected as MLA from Narnaul and served as State Minister in Haryana.

Mr. Narender Singh Yadav member of this Bar Association (now deceased) elected and remained as Chairperson of Zila Prishad Narnaul.

Mr. Chaudhary Kishan Sahai Dhillo from village Deroli Jat was appointed as Honorary Magistrate in Patiala State.

Mr. Thakur Mohar Singh of village Kanti was Nazim in Erstwhile State of Nabha.

Mr. Manish Chaudhary, previously member of this Bar Association, has been directly selected as ADJ in Gujrat.

Mr. J. S. Yadav, previously member of this Bar Association, has been directly selected as ADJ in M.P.

Mr. Dinesh Sharma previously member of this Bar Association, has been directly selected as ADJ in Bihar.
